These Terms of Service ("Agreement") govern your use of the Hotel Savvy website and membership-based travel services, and business travel subscribers, as well as referral partners  (collectively referred to as the "Service"), provided by Hotel Savvy, LLC, doing business as Hotel Savvy.com  ("Hotel Savvy," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree with any provision of this Agreement, please do not use the Service.

Our basic principles:

• We don't sell or share your personally identifiable information (name, address, email, phone, etc.) See our Privacy Policy.

• Our providers have access to this information only if you book a reservation with them, and they have rights to your information based on their booking terms of service.

• When you book with us, subscribe to our services, or become a referral partner, you are agreeing to our privacy policy and these terms of service.

 

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by this Agreement, including any additional terms and conditions, policies, and guidelines referenced herein or available on the Hotel Savvy website. When booking on the Hotel Savvy website, you agree to those terms of service and privacy policy.

2. Membership and Account
2.1. Eligibility
You must be at least 18 years old to create an account and become a member of Hotel Savvy. By creating an account, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement.

2.2. Account Creation and Security
To access certain features of the Service, you must create a membership account. You agree to provide accurate, complete, and up-to-date information during the registration process and to keep your account information current. You are responsible for maintaining the confidentiality of your account credentials and for any activities that occur under your account. You must promptly notify Hotel Savvy of any unauthorized use of your account or any other breach of security.

3. Privacy and Data Protection

Hotel Savvy respects your privacy and is committed to protecting your personal information. We will only collect and use your personal data as outlined in our Privacy Policy, which forms an integral part of this Agreement. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

3.2. Marketing Communications
With your explicit consent, Hotel Savvy may use your contact information to send you marketing communications related to our services, promotions, and offers. You have the right to opt-out of receiving such communications at any time by following the unsubscribe instructions provided in the communication or by contacting us directly.

3.3. GDPR Compliance
Hotel Savvy is committed to complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We will take all reasonable measures to ensure the security and confidentiality of your personal data and to process it only in accordance with applicable law and your consent.

4. Intellectual Property Rights
The Service, including but not limited to the Hotel Savvy website, trademarks, logos, designs, graphics, and other content, are owned or licensed by Hotel Savvy and are protected by intellectual property laws. You agree not to copy, modify, distribute, display, or exploit any part of the Service without the prior written consent of Hotel Savvy.

5. Content and User Conduct
5.1. User-Generated Content
You may have the opportunity to post, submit, or transmit content on or through the Service, including reviews, comments, and other materials ("User Content"). You retain ownership of your User Content but grant Hotel Savvy a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of providing the Service.

5.2. Prohibited Conduct
You agree not to engage in any conduct that:
5.2.1. Violates any applicable law or regulation;
5.2.2. Infringes upon the rights of others;
5.2.3. Harasses, threatens, or intimidates any person;
5.2.4. Interferes with or disrupts the Service or servers or networks connected to the Service;
5.2.5. Attempts to gain unauthorized access to the Service or any accounts, systems, or networks related to the Service; or
5.2.6. Impersonates any person or entity or falsely states or misrepresents your affiliation with any person or entity.

6. Limitation of Liability
To the maximum extent permitted by applicable law, Hotel Savvy and its affiliates, officers, directors, employees, agents, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory.

7. Modification and Termination
Hotel Savvy reserves the right to modify, suspend, or discontinue the Service or any part thereof at any time without notice. We may also terminate your access to the Service or your membership account, in our sole discretion, for any reason or no reason, without liability.

8. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the state of North Carolina, USA. Any dispute arising out of or in connection with this Agreement shall be resolved through good-faith negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association]. The prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

9. General Provisions
9.1. Entire Agreement
This Agreement, including any referenced policies and guidelines, constitutes the entire agreement between you and Hotel Savvy concerning the Service and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Hotel Savvy.

9.2. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9.3. Waiver
The failure of Hotel Savvy to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Hotel Savvy in writing.

9.4. Assignment
You may not assign or transfer any rights or obligations under this Agreement without the prior written consent of Hotel Savvy. Hotel Savvy may freely assign or transfer this Agreement without restriction.
